Microsoft seeks UK Supreme Court appeal after losing £270m software resale case

Microsoft is pursuing permission to appeal to the UK Supreme Court following a £270 million ruling in favour of software reseller ValueLicensing. The Competition Appeal Tribunal ruled in 2025 that reselling Microsoft's perpetual on-premise licences did not constitute copyright infringement. The Court of Appeal upheld that decision on July 7, with judges drawing parallels to the 2012 UsedSoft ruling that previously went against Oracle. A partial stay has been granted, allowing disclosure applications to continue, with a related hearing anticipated in September.
