Kentucky court denies couple's bid for easement over neighbours' driveway

A Kentucky court has ruled against Charlie and Kathy Stearns in a property dispute with their neighbours, John and Betty Warinner. The Stearnses had argued that their long-standing use of a pathway across the Warinners' land entitled them to an implied easement. A jury, however, concluded that other workable access routes existed, and it dismissed the claim. The appeals court upheld that verdict. The ruling establishes that long-term use alone does not automatically create a legal easement.
