Allahabad HC: Governor Cannot Arbitrarily Deny Convict's Premature Release

The Allahabad High Court has ruled that a governor's power to grant or refuse premature release cannot be exercised arbitrarily. The observation was made by a bench comprising Justices J J Munir and Tarun Saxena. The court was hearing the case of a convict who had been sentenced to seven years of rigorous imprisonment. The bench quashed an order that had refused premature release to the said convict. The ruling underscores that such executive discretion must be exercised in a fair and reasoned manner.
